Uncle Paul and Uncle Pabai have taken the Australian Government to court for its failure to act on climate change and the devastating impact on communities, culture and Country in the Torres Strait.
The loss these communities face is unimaginable. In the witness box, during the on-Country hearing on his island of Boigu, Uncle Pabai told the court “They [the ancestors] are giving us who we are today. They are the most important people to us. When we do a ceremony, we invite them, call upon them. If I can’t do that because my community goes underwater I will lose my identity underwater. I will lose everything that is important to us.”
With the generous support of the Grata community we’ve been able to ensure that Uncle Pabai, Uncle Paul and community witnesses have the best legal team and barristers available, and that the court hears the community evidence on-Country. However, the fight is far from over. This week Justice Wigney will hear from more community witnesses in Saibai and Cairns. In November at the Federal Court in Melbourne Justice Wigney will hear the second part of the case including expert evidence from climate and policy experts, the Australian Government’s witnesses and arguments about the law
Running a case like this is incredibly expensive and the next phase alone, to fund expert reports, court costs and travel will cost hundreds of thousands of dollars.
